Binary Options in Australia: ASIC’s Retail Ban Through 2031

ASIC’s product intervention order is the central source for Australian retail binary-options research. A platform’s offshore address or Australian-facing payment route does not answer the product-permission question.

Published · Updated · 7 min read

Binary options are banned for Australian retail clients under ASIC’s product intervention framework. ASIC’s extension announcement states that the order runs until 1 October 2031. An offshore website accepting an Australian registration does not establish permission for its offer.

This guide explains the dated sources, scope and evidence checks that matter when assessing an Australian-facing promotion. Official ASIC and Moneysmart material was checked on 24 October 2026. It is general research rather than an individual legal assessment.

ASIC’s binary-options ban: original order and extension

ASIC says the original order took effect on 3 May 2021 and that its extension prohibits issuing and distributing binary options to retail clients until 1 October 2031. The extension announcement is therefore important when reviewing material that refers only to an earlier expiry.

Source event Date or scope Research implication
Original order effective 3 May 2021. Earlier reviews may describe a previous framework.
Extended period Until 1 October 2031. Do not treat an old expiry as the current endpoint.
Customer scope Retail clients. Customer classification is material.
Article source check 24 October 2026. Recheck official updates before a later decision.

An announced end date does not guarantee what the rules will be after it. Do not advertise future legality in 2031 based on today’s document; later extensions, replacements or other rules would require a fresh check.

What ASIC’s historical loss figures do—and do not—show

The extension announcement reports that 74–77% of active retail clients lost money in the 13 months before the ban, with aggregate net losses of A$14 million. It describes analysis using data from five licensed issuers. Those figures refer to a defined historic dataset.

They are not a current worldwide loss rate for every platform, a measured probability for the next trade or an evaluation of a particular reader’s account. Preserve the observation period and population whenever citing them.

Likewise, a personal winning streak does not rebut a dataset about many accounts, and a population loss rate does not calculate the outcome of one contract. These statements answer different statistical questions.

Read the contract instead of relying on a product nickname

Ask which event determines the payout, when it is evaluated, what the successful outcome pays and how much the unsuccessful outcome loses. Save the specification rather than accepting a label such as “digital”, “AI prediction” or “fixed return” as the classification.

For a fictional example, a website offers a fixed payment if a currency price exceeds a threshold after one minute and loss of the stake otherwise. Calling that interface a game or technology tool does not answer the relevant product-law question. An unusual arrangement needs assessment based on its actual terms.

A different underlying asset also does not supply permission. A contract referencing gold, a share index or crypto still needs its own scope analysis. Do not infer a legal conclusion from the familiarity of the asset name.

Retail versus wholesale: understand the consequences

Moneysmart’s current binary-options page warns that some providers may try to classify customers as wholesale clients and that wholesale clients do not have the same consumer protections. It says not to agree to that treatment simply to access binary options.

Do not assume that a salesperson’s “professional” or “VIP” label establishes a legally valid classification. Ask what category is proposed, its legal basis and what protections or complaint options may change.

This article does not determine whether a particular person meets a classification test. If that question arises, get advice suited to the arrangement before making declarations. A promotional questionnaire should not substitute for understanding the consequences.

Australian access, AUD balances and overseas licences

A registration page may accept an Australian phone number, display an AUD balance or offer a familiar payment route. Those are operational observations. They do not establish compliance with the retail product restriction.

Similarly, identify precisely what an overseas licence claim covers. A brand can use several legal entities, and a company registration is different from financial permission. Do not let a certificate from one jurisdiction answer an unrelated question about an Australian retail offer.

Observed claim What it establishes at most What still needs checking
“Australian clients accepted” A stated onboarding policy. Product and customer permission.
AUD account balance An interface currency. Legal scope and actual cash records.
App-store availability A software distribution listing. Publisher identity and financial permission.
Overseas licence number A claim requiring independent verification. Exact entity, activities and Australian relevance.
Successful small payout One transaction, if reconciled. Future reliability and applicable protections.

A practical evidence checklist for a suspicious offer

  1. Save the full domain, advertisement, contact channel and date.
  2. Identify the contract issuer and proposed customer category.
  3. Retain the actual payout, expiry and loss specification.
  4. Compare claimed permission with current official sources.
  5. Preserve payment details, statements and correspondence if money was sent.
  6. Record unresolved contradictions rather than treating access as approval.

Use a research note with separate columns for claim, source and conclusion. “The page shows Australian testimonials” belongs in the claim column. “The offer is permitted for me” needs different evidence and cannot be inferred from testimonials.

If funds or documents have already been sent

Use genuine ASIC and Moneysmart routes for current reporting and consumer guidance. Contact the relevant payment institution promptly about suspected fraud or unauthorised activity, keeping references and dates available.

Secure exposed credentials through a trusted route and preserve relevant records where safe. Do not continue paying merely to obtain more screenshots. A platform balance does not prove recoverable money exists outside its interface.

A complaint, regulatory report and bank investigation serve different functions. Verify which organisation covers the actual entity and transaction. An upfront recovery promise is not evidence that a caller controls the funds or can reverse the payment.

Frequently asked questions

Can Australian retail clients access binary options legally just because a site accepts them?

Acceptance by a website does not establish compliance with the cited ASIC restriction. Assess the offer against the official framework.

Does the ban end automatically in practical terms in 2031?

The reviewed extension states its endpoint, but the rules applicable then require a fresh check. Do not assume future access.

Are the 74–77% loss figures current global statistics?

No. They describe the historical population and period reported by ASIC.

Does a demo account remove the retail restriction for funded trading?

No. Virtual practice is not evidence of permission to issue a real-money contract.
