Binary Options Broker Regulatory Status & Warning Research

BBH RESEARCH LIBRARY · REVIEWED SOURCES · OCTOBER 2026

How to verify a claimed licence, operating company and product permission using primary regulator sources.

A registered company is not automatically a regulated broker

An incorporation record, offshore address, trade name, brand icon or website registration is not proof that a regulator authorised a particular investment product. Match the precise contractual entity, business number, registered address, domain, product permission and country in the official register.

Different brands and products, different entities

One global brand may use different contracting entities for residents of different countries. A licence granted to a particular entity for one product cannot be assumed to cover all offshore affiliates or binary-style contracts. Our research methodology records claim-versus-source distinctions.

Where to check

For India consult Reserve Bank of India and SEBI; for the UK consult FCA Register; for the US consult CFTC; for Australia consult ASIC. These are starting points, not a country-by-country legal opinion.

How we describe regulatory alerts

An official warning must be attributed accurately to the issuing regulator, exact entity/domain and the scope of activity it covers. A specific forex platform alert does not by itself justify a worldwide criminal accusation. Likewise absence from a list does not prove that a broker is approved.

Practical due-diligence checklist

Before registering or depositing, save the exact current public agreement, verify the corporate entity, query the authority’s register, examine product-specific restrictions and review the regulator’s advice about investor protection, disputes and compensation. REGULATORY EVIDENCE · ENTITY, PRODUCT, JURISDICTION

Deep-dive research and verification framework

Regulatory checks must match a named contracting company and the exact instrument to a current, official register or restriction—not a website badge.

Evidence reviewed: October 2026 · Verify official source dates before acting.

Legal incorporation, authorisation and product permission are different

A company can be legally registered in one place without holding authorisation to distribute a particular investment in another. A domain can display a familiar brand while customer agreements name another corporate entity. Check company number and name, the exact service being offered, business permissions, regulator warnings, customer classification and solicitation rules. A register hit for a similarly named company is not enough. Verify domains and contact details against the primary register before publishing an authorisation statement.

Compare official country restrictions without inventing universal rules

The FCA has prohibited firms acting in or from the UK from selling, marketing or distributing binary options to retail consumers since April 2019. ASIC extended its retail binary-options product intervention ban to October 2031. Canada's securities administrators describe restrictions in some jurisdictions for short-maturity binary options alongside broader securities and derivatives requirements. India has different regulator remits: RBI issues forex/ETP information and SEBI has warned about unregulated foreign trading portals. These are jurisdiction-specific statements, not a global declaration about every contract.

How to interpret warning lists and absence of a name

A regulator alert is a record with a particular scope and publication date. For example, RBI's Alert List concerns forex dealers and electronic trading platforms under its remit; the RBI says the list is not exhaustive and absence is not proof of permission. Similarly, an overseas enforcement item may not cover every subsidiary or product of a brand. Quote the exact regulator, entity and scope. If a company is not listed in a search, write 'not verified from this search' rather than labelling it authorised or illegal.

A repeatable entity-to-product verification method

Start with the customer agreement, not the marketing domain. Transcribe the legal company name and any registration number, identify the financial instrument and your country, then search the relevant regulator's primary database. Verify the permitted activities, limitations, effective dates, complaint scheme and whether the entity is currently authorised or was previously authorised. Save source URLs and access dates. Some registers require exact names or legal suffixes. If a source cannot be checked, leave a clear evidence gap rather than filling it with claims from partner websites.

Authority and review are separate from safety or profitability

Even a properly authorised intermediary is not a guarantee that high-risk derivatives are suitable or profitable. Conversely, an unavailable or unverified registration should not be described as proven wrongdoing without an official finding. For fixed-outcome short-expiry products, the entire stake may be lost. A credible research page should separately describe legal eligibility, counterparty risk, execution/price questions, payment and identity risk, and applicable dispute routes.

Questions to record before reaching a conclusion

  • What legal name and licence number appear in the binding terms?
  • Does the official register show permission for this exact instrument?
  • Is that authorisation valid for the customer jurisdiction and category?
  • Does an alert apply to this precise entity or only a similarly named business?
  • What is the regulator record date and where is the original source?

Frequently asked research questions

Is a company registration certificate a financial licence?

No. Incorporation and permission to distribute financial contracts are different matters.

Does an empty alert-list search prove authorisation?

No. Regulators including the RBI explicitly warn that some alert lists are not exhaustive.

Can a broker offer the same product to retail clients everywhere?

No. Local product restrictions and permissions vary substantially by jurisdiction.

Primary references and source limitations

Official rules have jurisdiction and product limits. A broker's own asset list documents a provider claim, not independent execution verification.
